TRAVIS COUNTY, TX – One person is in the hospital and another in police custody after an alleged drunk driving crash in Travis County Monday night.

According to KXAN, the accident occurred when 22-year-old Thomas Mayer failed to negotiate a turn on FM-2222 and collided with an excavator at a construction site.

Police say one of the passengers in Mayer’s vehicle was rushed to the hospital to be treated for a broken back. Mayer and another passenger were unharmed in the crash.

Officers conducted field sobriety and breathalyzer tests on Mayer. He failed both and was taken into custody on an intoxication assault charge.
